Eric S. Hutner, Esq.

Eric S. Hutner, Esq.

After graduating from New York University School of Law in the early 1980’s, Eric began his legal career in the litigation department of Willkie Farr & Gallagher, a leading U.S. law firm, representing a diverse array of corporate clients. After nine years at Willkie, he expanded his practice areas when he moved in-house to become General Counsel at two different investment banking/securities brokerage firms. He returned to private practice in 1999, and since then has represented many clients and handled a diverse portfolio of legal matters. The experiences he has had over the course of his career enable him to fill many roles for our clients.

General counsel- During a career of more than 30 years, Eric has honed the multiple skills needed to serve clients as their outside general counsel, effectively becoming part of the team involved in multiple aspects of a company’s business. From company formation through development as a mature business, this role draws on all of Eric’s legal, life and business experiences, and enables him to give value above and beyond what most clients expect.

Corporate lawyer- While litigation requires a savvy fighter and tactician, deal-making and contracts are best handled by a lawyer who understands the client’s business and needs, and can identify how to best realize the client’s objectives in a complicated business environment. Eric represents small and mid-size companies in various industries in mergers, acquisitions, contract negotiations, employment and trademark matters, private placement financings and investment transactions, and more.

Regulatory and arbitration counsel– Eric has represented clients in well more than one hundred FINRA arbitrations, and has learned the lessons of when to fight, when to fight hard, and when settlement is in the client’s best interests. He has also represented securities industry professionals in a wide range of regulatory and enforcement actions brought by FINRA, the SEC and various state regulators, matters that involve both relatively straightforward rules violations all the way to potentially career-ending securities fraud cases. Clients often are introduced to Eric by industry veterans and other attorneys who have seen him in action. He also takes time to serve as a FINRA Arbitrator, not only to give something back, but to understand how to better represent his arbitration clients.

Litigator- Eric has been litigating in federal and state courts, at both the trial and appellate levels, since the beginning of his career. In his early “big firm” days, he typically worked on teams that represented large American investment banks and companies — at times in “bet the company” cases, and more recently has been battling on behalf of smaller companies and individuals in varied business-related matters. The breadth of these cases and clients, combined with a well-honed sense of scope and seasoned judgment, enable him to represent clients effectively and cost-efficiently.
